3 - Application of the present general sales conditions

The fact for a user to place an order (by filling the form with name and address) and to confirm this order involved the buyer to completely subscribe the general conditions of sale. The Products are shown and made visible on the website accurately and in a way corresponding to their real characteristics. However, Ftp-Cd is not in a position to guarantee exact correspondence to the real garments in terms of image and colours as these appear on the Customer's monitor. The Products presented on the website may no longer be available or on sale at the time the site is accessed by the user and that the relevant prices could undergo updating.

4 - Contract

Orders become definitive and a sale Contract is concluded as soon as the order is totally paid by the customer by the using one of the procedures indicated on the website (by creditcard on the secure website of the french C.I.C Bank) and insofar as the payment is charged to the Customer by the company Ftp-Cd.

5 - Delivery period

The delivery period is of approximately 7 (seven) open days for the Member States of the European Union, once the sale Contract concluded in accordance with the terms described para. 4 from these General Conditions. This period is given as an indication and the company Ftp-Cd will endeavour to respect this time as far as possible. The delivery period is variable according to the delivery place. In the event of unavailability of the ordered product, the company Ftp-Cd informs the customer by email. The customer will be able in this case to ask for the refunding of the versed sums. The company Ftp-Cd is committed refunding the customer within 30 (thirty) days as from the reception of the request for refunding. The seller is not required to deliver in case of major force : war, riot, fire, strike, accidents and impossibility of beeing supplied.

6 - Price

Prices are given in Euro. All prices are inclusive of VAT. The customer is responsible of the eventual charges, local taxes or taxes of importation. The customer is considered as importer of the products concerned.

7 - Right of withdrawal

The Customer is entitled to withdraw from the Contract, without any penalty and without specifying the reason within 7 (seven) open days of receipt of the Products. The right of withdrawal can be exercised within the aforementioned term by informing Ftp-Cd by mail or e-mail, and by fullfilling the following conditions :
- the returned Products must be in the same conditions in which they were at the time of dispatch
- the Products must not have been used
- the Products must be returned in their original packaging accompanied by a ticked with the Contract reference number.

If the right to withdraw is exercised by the Customer in conformity with the provisions of these General sales conditions, Ftp-Cd shall refund any sums already paid, net of any shipping costs to the Customer, as quickly as possible and, always, within 30 (thirty) days from the date on which it became aware of the Customer's decision to exercise its right to withdraw.
In the event of the conditions established in these General sales conditions for correctly exercising the right to withdraw not being observed, the Customer shall not be entitled to any refund of the sums already paid to Ftp-Cd; nevertheless, the Customer shall be entitled, at its own expense, to the return of the Products in the condition in which they were sent back to Ftp-Cd.
It remains understood that if the Customer decides not to make use of the faculty indicated above, Ftp-Cd shall be entitled to withhold the Products and the sums already received.

8 - Absence of responsibility.

Ftp-Cd will not be liable for any damages of any kind arising from the use of this website and presented products ,including but not limited to direct, indirect, incidental , punitive and consequential damages.
